Supreme Court’s 8-Point Framework for Alimony
The Supreme Court has introduced an eight-point guideline to streamline decisions on alimony in divorce cases. This decision comes amid heightened discussions following the tragic suicide of Bengaluru-based techie Atul Subhash, who accused his estranged wife and her family of harassment and extortion.
A bench comprising Justice Vikram Nath and Justice PV Varale emphasized the importance of balancing fairness while determining alimony amounts. The court urged judicial bodies nationwide to consider these factors, ensuring a just and equitable approach.
Key Factors for Deciding Alimony
The apex court outlined the following considerations for determining permanent alimony:
- Social and economic status of both husband and wife
- Basic needs of the wife and children for the future
- Educational qualifications and employment of both parties
- Income sources and property ownership of both individuals
- The wife’s standard of living while residing in her in-laws’ household
- Whether the wife left her job to manage family responsibilities
- Reasonable legal expenses for an unemployed wife
- The husband’s financial capacity, earnings, and other responsibilities
The court clarified that these factors are not a rigid formula but guidelines to help courts arrive at fair decisions.
“The amount of permanent alimony should not penalize the husband but should aim to ensure a decent standard of living for the wife,” the bench noted.
Techie’s Suicide Sparks National Debate
The case of Atul Subhash has cast a spotlight on the alleged misuse of dowry laws in India. Atul, a native of Bihar, recorded an 80-minute video and penned a 24-page suicide note before taking his life. He accused his estranged wife, Nikita Singhania, and her family of filing multiple cases to extort money.
Atul’s note, inscribed with the words “Justice is Due” on every page, criticized the legal system for enabling harassment through misuse of Section 498A of the IPC, which addresses cruelty against women.
The couple had married in 2019 after meeting through a matchmaking website and welcomed a son in 2020. Atul alleged that Nikita and her family repeatedly demanded money, escalating their claims from ₹1 crore to ₹3 crore after she left their Bengaluru home in 2021.
Supreme Court on Misuse of Dowry Laws
In a related development, a Supreme Court bench led by Justices BV Nagarathna and N Kotiswar Singh dismissed a dowry case, citing misuse of Section 498A as a tool for personal vendetta.
The court observed that while the provision is critical for protecting women, its exploitation undermines genuine cases and burdens the legal system.
