Doctors Fined Rs 11 Crore for Medical negligence in Woman’s Death in Malaysia
In a landmark case of medical negligence, two doctors in Malaysia have been ordered to pay a hefty fine of 6 million ringgit (approximately Rs 11.42 crore) to the family of a woman who tragically died from excessive bleeding after childbirth. The High Court in Klang, Selangor, found the doctors and three nurses at fault for their failure to provide adequate care during a critical medical emergency in 2019.
A Preventable Tragedy
Punitha Mohan, a mother of two, was admitted to the Shan Clinic and Birth Centre in Klang for the delivery of her second child. While the delivery was successful, complications arose when her placenta was removed, leading to severe post-partum hemorrhaging.
Justice Norliza Othman, delivering the verdict, highlighted that the two specialist doctors, Muniandi Shanmugam and Akambaram Ravi, neglected their professional responsibilities. The court found that Dr. Ravi had left the hospital to get a drink, leaving the patient in the care of unqualified nurses who were unable to manage the escalating crisis.
Punitha’s mother raised the alarm upon noticing her daughter bleeding heavily. Despite their efforts, the nurses could not control the bleeding. Punitha was eventually transferred to Hospital Tengku Ampuan Rahimah Klang (HTAR) in critical condition, but it was too late to save her life.
Court Ruling and Compensation
The court ruled that the tragic incident could have been avoided if the doctors had acted promptly. Justice Othman stated that the doctors failed to account for common childbirth complications such as eclampsia and placenta-related issues, which often result in post-partum hemorrhage (PPH).
The financial compensation was divided as follows:
- Rs 95 lakh for the deceased woman’s pain and suffering.
- Rs 1.9 crore for each of her two children.
- Rs 57 lakh for each of her parents.
The judgment also criticized the use of unqualified nurses by the clinic, which further compounded the failure of care.
Implications of the Verdict
Justice Othman’s decision underscores the critical need for accountability in healthcare. She stated that Dr. Ravi’s decision to leave the clinic while the patient’s condition was critical represented “unforgivable neglect.” The judgment sends a strong message to medical practitioners about their duty of care and the dire consequences of lapses in professional responsibility.
This case also highlights systemic issues in private healthcare facilities, including the employment of unqualified staff and the lack of preparedness for emergencies. Experts stress the need for better regulation of private clinics and mandatory qualifications for medical personnel.
The tragic death of Punitha Mohan underscores the importance of vigilance, prompt action, and adherence to medical protocols. While the financial compensation offers some solace to her grieving family, the judgment serves as a critical reminder to healthcare providers about the need for uncompromising standards in patient care.
